  • Retaliation: Employees cannot be fired for reporting a range of illegal activities in the workplace, whether they are the victims or not. Both state and federal law bar a person from being terminated for complaining, reporting, or requesting:
    • workplace safety conditions
    • wage fairness
    • harassment or discrimination in the workplace
    • disability accommodations
    • illegal or fraudulent activities of the employer
  • Violating written or implied promises: Employers must follow all employee contracts, including employment timeframes outlined in a contract as well as company policies when it comes to disciplinary procedures.
  • Violating public policy: A person cannot be fired for taking time off the vote, for jury duty, or to serve in the military or national guard. In addition, a person cannot be fired for taking time off for reasons covered in the Family and Medical Leave Act (FMLA) or the California Family Rights Act (FRA).
