There are very few people who want to be fired from their jobs. While there are times when firing an employee is justified, there are also cases in which a person is wrongfully terminated. At the Azadian Law Group, PC, we know that workers are wrongfully terminated from their jobs all the time. However, it is not always clear why an employee fires someone, as they may attempt to cover up the real reason for termination. Our Los Angeles wrongful termination lawyers want to discuss how you can recognize the real reason why you were fired.

There are often no signs of illegal firing

If you have been fired from your job and you do not think it was due to your job performance of general downsizing at the company, you may have been terminated for an illegal reason. According to the ACLU, around 150,000 people are wrongfully terminated from their jobs each year in the US. There are several illegal reasons people are fired, including the following:

  • Workplace discrimination: According to the US Equal Employment Opportunity Commission, there were more than 76,000 charges of discrimination brought against employers during the latest reporting year of data. This includes discrimination based on a person’s:
    • Race or ethnicity
    • Religion
    • Disability
    • Age
    • Sex or gender
    • Sexual orientation (protected by California, not the federal government)
  • Retaliation: Employees cannot be fired for reporting a range of illegal activities in the workplace, whether they are the victims or not. Both state and federal law bar a person from being terminated for complaining, reporting, or requesting:
    • workplace safety conditions
    • wage fairness
    • harassment or discrimination in the workplace
    • disability accommodations
    • illegal or fraudulent activities of the employer
  • Violating written or implied promises: Employers must follow all employee contracts, including employment timeframes outlined in a contract as well as company policies when it comes to disciplinary procedures.
  • Violating public policy: A person cannot be fired for taking time off the vote, for jury duty, or to serve in the military or national guard. In addition, a person cannot be fired for taking time off for reasons covered in the Family and Medical Leave Act (FMLA) or the California Family Rights Act (FRA).
