How is overtime calculated in Orange County, California?
When you work, you deserve to get paid for each and every minute. However, some of those minutes are more valuable. We call those minutes overtime.
Ask yourself two questions:
- Have you worked more than 8 hours in a day?
- Have you worked more than 40 hours in a week?
If so, you are entitled to 1.5 times your regular hourly rate. If you work more than 12 hours in a day, you are eligible for more than double your regular hourly rate.
What if you are not an hourly employee?
Overtime pay for salaried employees is a bit harder to calculate, but it can be done by using your salary and calculating what would be your hourly rate to come up with the overtime amount you should be paid.
Employers who are covered under the federal Fair Labor Standards Act (FLSA) must pay employees overtime. Employers fall under FLSA if they generate more than $500,000 annually in sales. Companies that do not fall under FLSA generally fall under California overtime law which protects employees.
Are there exemptions for Orange County overtime pay?
There are some employees in California who are not eligible to receive overtime pay. In general, these will be:
- Administrative employees(who earn more than twice the minimum wage)
- Executive employees (who earn more than twice the minimum wage)
- Professional employees(who earn more than twice the minimum wage)

- Volunteer workers
- Seasonal recreational and amusement workers
- Some public safety personnel
- Small farm workers
