What this AI recruiting lawsuit alleged

Heidi Saas sued Major, Lindsey & Africa and Allegis Group, alleging that algorithmic and machine-learning recruiting tools discriminated by sex and age, including against women with gaps in employment.

What the courts decided

On May 10, 2024, the district court dismissed the claims. It found the AI-use theory speculative and insufficiently tied to a particular employment practice. Defendants denied using AI tools.

On November 21, 2024, the Fourth Circuit affirmed. Its opinion is unpublished and is not binding precedent in that circuit. These rulings do not establish discriminatory AI use or exempt other recruiting systems from discrimination law.
