You have rights when you are pregnant or have given birth in Pasadena, CA
Far too often, women are left suffering in their careers and economic opportunity because of discrimination due to pregnancy. However, you need to know that the California Fair Employment and Housing Act (FEHA) protects against pregnancy discrimination. This law applies to all state employers with five or more employees and prohibits discrimination when it comes to all aspect of employment, including:
- Interviewing and hiring
- Firing decisions
- Layoff decisions
- Pay equality
- Promotion opportunities
- Other employment benefits
You can also not be retaliated against or fired for taking or requesting to take your pregnancy medical leave.
You are protected during and after pregnancy
When it comes to the time you are allowed to take off from work, the law affords you:
- Up to four weeks off before giving birth
- Up to six weeks off after a vaginal delivery
- Up to eight weeks off after a C-section delivery
You may also be eligible for more time if your employer has to comply with the California Family Rights Act and the federal Family Medical Leave Act.
During your pregnancy, your employer should work with you to provide reasonable accommodations for you to do your job. This can include things like allowing you to temporarily transfer to a position with less strenuous requirements or to possibly work from home. It can also include allowing you longer breaks, to sit on a stool instead of stand, or minor modifications in your work duties.
You could be eligible for more time
You could be eligible to take an additional 12 weeks of bonding time with your child if your employer has 20 or more employees.
You have to be returned to the same position
Once you return from pregnancy leave, you must be given the same position with the same pay you had before or a job with comparable pay and duties.
